This Statement of Privacy applies to Transcend the Binary (“Transcend”) and www.transcendthebinary.org, governing our data collection and usage.  By using Transcend’s website, you consent to the data practices described within this statement.

Personal information

We do not collect any personal information about you unless you voluntarily provide it to us.

You may voluntarily provide us with certain personal information when you elect to use products or services available on our website.

(a) registering for an account on our site;

(b) entering sweepstakes, contests or signing up for special offers by us or an affiliate third party;

(c) sending us an email message or contact submission on our website;

(d) signing up for our regular newsletter or requesting additional information about our services, training, educational services, or direct client care services;

(e) submitting your credit card, PayPal, or other payment information when ordering or purchasing products/services on our site;

(f) submitting your information, credit card, PayPal, or other information when making a donation to support our trans-led programs and services;

(g) submitting direct feedback with a request for a Transcend team member to follow up to gather more information, details, or otherwise;

(h) enrolling in our HIPAA-compliant direct services and completion of new client paperwork;

(i) enrolling in our health and wellness programs, which may include but are not limited to direct consultations, referral information, and our fitness app;

(j) directly submitting comments on our posts, social media, or messages sent to social media channels;

(k) other charitable purposes that serve our mission and comply with IRS statutes for 501c3 standing.

We will use your information for communicating with you, provision of direct services and delivery of products, delivery of mobile apps and digital download materials, answering your questions, linkage to resources and referral networks, direct care services, analyzing de-identified information about our site traffic, and other uses that support our trans-led mission of advancing health and wellness for our gender diverse community. This may include statistical analysis of our website traffic, user preferences, the popularity of devices used among our users/clients/website viewers, what content is highly trafficked, what content is less popular, and other uses that will allow us to continually provide a better user experience and share the information that you want, easily and accessibly – the ultimate goals of our website and digital services. We may gather additional personal or non-personal information in the future.

Third parties

Transcend the Binary does not sell, rent, or lease its customer lists to third parties.

Transcend the Binary may work with trusted partners to help perform statistical analysis on our website traffic or client experience; which we will prioritize de-identified information wherever appropriate and/or possible. Trusted partners shall be prohibited from using your personal information except to aid us in fulfilling our vision of providing superior quality and comprehensive support for our trans/gender diverse community and aforementioned services. Visitor comments may be checked through an automated spam detection service. We may send you email or postal mail, provide customer support, arrange for deliveries, gather follow-up feedback from you on our services or referral network partners/providers, coordinate care services, provide you with requested referrals, follow up with information on additional research requests or care navigation information. Transcend and any such trusted partners are required to maintain the confidentiality of your information, wherever personal information has been shared.

Transcend the Binary may disclose such voluntarily provided information without notice if required to do so by law or in the good faith belief that such action is necessary to:

(a) comply with legal statutes or legal processes served on Transcend the Binary;

(b) protect and defend the rights or property of Transcend the Binary;

(c) act under exigent circumstances to protect the personal safety of users of Transcend the Binary, client’s safety, the safety of our team, or the public.

Automatically collected information

Information about your computer hardware and software may be automatically collected by Transcend. This information can include your IP address, browser type, domain names, access times, and referring website addresses. This information is used for the operation of services, to maintain the quality of our services, and to provide general statistics regarding the use of the Transcend website.

Links and embedded content

This website contains links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. Children under the age of thirteen

Transcend the Binary does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.

Your Transcend account

As we continue to build out our digitally-accessible services, you may be able to connect Transcend accounts to third-party software or accounts. By connecting any of your Transcend accounts to third party accounts or services, you acknowledge and agree that you are consenting to the third-party policies. Do not use these features if you do not wish to connect to third-party accounts; Transcend is not responsible for such policies.

Email communications

From time to time, Transcend the Binary may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. If you would like to stop receiving marketing or promotional communications via email from Transcend, you may opt-out of such communications and may unsubscribe from emails by clicking on the UNSUBSCRIBE button. Please note that doing so is not automatic, and there may be a delay when replying via email with the wish to unsubscribe. Clicking on UNSUBSCRIBE will be a more direct action and will go into effect sooner.

Retention of data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Your rights to your data

If you have an account on this site or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
